Ten Provisions on Quality and Safety Responsibility for Construction Project Managers (Trial)
I. The construction project manager (hereinafter referred to as the project manager) must obtain the relevant professional qualifications and safety production assessment qualification certificates in accordance with the regulations; the project manager agreed in the contract must perform his or her duties on the job, and must not violate the regulations on two or more engineering projects at the same time Act as project manager.
Second, the project manager must be fully responsible for the quality and safety of the construction of the project, responsible for establishing a quality and safety management system, responsible for assigning full-time quality, safety and other construction site management personnel, responsible for implementing the quality and safety responsibility system, quality and safety management rules and regulations and operating procedures.
3. The project manager must organize the construction in accordance with the engineering design drawings and technical standards, and must not cut corners. Responsible for the organization of the construction organization design, responsible for the formulation of quality and safety technical measures, responsible for the preparation, demonstration, and implementation of the more dangerous sub-project special construction plans. ; Responsible for organizing quality and safety technical disclosure.
4. The project manager must organize the inspection of the building materials, components, equipment, ready-mixed concrete, etc. that have entered the site. They must not be used without inspection or unqualified inspection. They must organize the test blocks, test pieces and related related to structural safety. The materials shall be sampled and tested. The samples submitted for inspection shall not be falsified, shall not be tampered with or falsify the test report, and shall not expressly or imply that the testing agency shall issue a false test report.
V. The project manager must organize the acceptance of the concealed project, participate in the acceptance of sub-soil projects such as foundation, main structure, and participate in the acceptance of the unit's project and the completion of the project; they must sign the acceptance document and not sign false documents.
6. The project manager must take shifts during the construction of some sub-projects that are more dangerous, such as crane installation, disassembly, and formwork erection; they must organize acceptance inspections before using the hoisting machinery, formwork support, etc., without acceptance or unqualified acceptance. It must not be used; daily inspections must be organized during the use of lifting appliances, and lifting appliances that have failed safety protection devices must not be used.
7. The project manager must use the full amount of safety production costs for safety protection and safety measures, and shall not divert them to other purposes; operators shall not be equipped with safety protective equipment, and shall not be employed; it is strictly forbidden to eliminate or prohibit the use of materials that endanger construction quality and safety. 8. The project manager must regularly organize potential quality and safety hazard investigations to eliminate the quality and safety hazards in a timely manner; must implement the requirements for rectification of potential quality and safety hazards proposed by the competent department of housing urban and rural construction and engineering construction related units, and sign on the report of rectification of potential hazards.

10. The project manager must report quality and safety accidents in accordance with regulations, immediately launch emergency plans, protect the scene of the accident, and carry out emergency rescue.
The construction enterprise shall check the performance of the project manager on a regular or irregular basis. If it is found that the performance of the project manager is not in place, it shall be corrected in time; if necessary, the qualified project manager shall be replaced in accordance with the prescribed procedures.
The competent department of housing urban and rural construction shall strengthen the dynamic supervision of the performance of the project manager. If the project manager is found to violate the above provisions during the inspection, administrative penalties shall be implemented in accordance with relevant laws, regulations and rules. Provisions on Administrative Penalties for Construction Project Managers' Quality and Safety Violations
I. Administrative penalties for violation of the first provision
(1) Whoever fails to obtain the registration certificate of construction engineer qualification as a manager of a large or medium-sized engineering project shall impose administrative penalties on the project manager in accordance with Article 35 of the “Regulations for the Management of Registered Construction Engineers”.
(2) If the project manager has not obtained the certificate of safety in production assessment, the construction unit shall impose administrative penalties in accordance with Article 62 of the "Regulations on the Safety of Production Engineering Management" and the project manager in accordance with Article 58 of the "Regulations on Safety in Production Engineering Management" Or Article 66 provides for administrative penalties.
(3) Whoever acts as a project manager on two or more engineering projects in violation of the regulations shall impose administrative penalties on the project manager in accordance with Article 37 of the "Registration Regulations for Registered Builders".
Administrative penalties for violating the second provision
(1) If the project safety production responsibility system is not implemented, or the quality safety management rules and regulations and operating procedures are not implemented, the project manager shall implement administrative penalties in accordance with Article 58 or 66 of the Construction Engineering Safety Production Management Regulations.
(2) If full-time safety production management personnel are not provided according to the regulations, the construction unit shall impose administrative penalties in accordance with Article 62 of the “Regulations on Safety Management of Construction Engineering” and impose on the project manager in accordance with Article 58 of the “Regulations on Safety Management of Construction Engineering” or Article 66 provides for administrative penalties.
3. Administrative penalties for violation of the third provision
(1) If the construction is not organized in accordance with the engineering design drawings and technical standards, the construction unit shall be imposed administrative penalties in accordance with Article 64 of the Construction Engineering Quality Management Regulations; the project manager shall be implemented in accordance with Article 73 of the Construction Engineering Quality Management Regulations Administrative penalties.
(2) If safety technical measures have not been formulated in the design of the construction organization, the construction unit shall impose administrative penalties in accordance with Article 65 of the “Regulations on the Administration of Work Safety in Construction Engineering”; Or Article 66 provides for administrative penalties.
(3) Failure to prepare a special construction plan for a more dangerous sub-item project shall impose administrative penalties on the construction unit in accordance with Article 65 of the "Regulations on the Management of Work Safety in Construction Engineering"; Article 58 or Article 66 provides for administrative penalties.
(4) If no safety technical transfer is made, the construction unit shall impose administrative penalties in accordance with Article 64 of the “Regulations on the Administration of Work Safety in Construction Projects”; Implement administrative penalties.
4. Administrative penalties for violating the fourth provision
(1) Failure to inspect the building materials, building components, equipment, ready-mixed concrete, etc. entering the site shall impose administrative penalties on the construction unit in accordance with Article 65 of the "Regulations on Construction Project Quality Management"; Article 73 of the Construction Quality Management Regulations provides for administrative penalties.
(2) For the use of unqualified building materials, construction components, and equipment, the construction unit shall impose administrative penalties in accordance with Article 64 of the Construction Engineering Quality Management Regulations; the project manager shall comply with Article 73 of the Construction Engineering Quality Management Regulations Provide for administrative penalties.
(3) Failure to sample and test the test blocks, test pieces and related materials related to structural safety shall impose administrative penalties on the construction unit in accordance with Article 65 of the Construction Project Quality Management Regulations; the project manager shall comply with the Construction Project Quality Management Regulations Article 73 provides for administrative penalties.
V. Administrative penalties for violating the fifth provision
(1) Failure to participate in the acceptance of the branch project, unit project, and project completion shall impose administrative penalties on the construction unit in accordance with Article 64 of the Construction Project Quality Management Regulations; the project manager shall comply with Article 73 of the Construction Project Quality Management Regulations Provide for administrative penalties.
(2) In case of signing false documents, the project manager shall impose administrative penalties in accordance with Article 37 of the “Regulations for the Management of Registered Builders”.
6. Administrative penalties for violation of the sixth provision
The use of cranes without experience acceptance or unqualified acceptance shall impose administrative penalties on the construction unit in accordance with Article 65 of the “Regulations on the Management of Work Safety in Construction Projects”; Article 66 provides for administrative penalties.
7. Administrative penalties for violation of the seventh provision
(1) In the case of misappropriation of production safety costs, the construction unit shall impose administrative penalties in accordance with Article 63 of the “Regulations on the Management of Work Safety in Construction Engineering”; Administrative penalties.
(2) If safety protective equipment is not provided to the workers, the construction unit shall impose administrative penalties in accordance with Article 62 of the "Regulations on the Administration of Work Safety in Construction Engineering"; Article 66 provides for administrative penalties.
(3) In the case of use of processes, equipment and materials that endanger construction safety, which have been eliminated or banned by the state, the construction unit shall impose administrative penalties in accordance with Article 62 of the “Regulations on the Management of Construction Safety Production”; Article 58 or 66 of the Regulations on Production Management provides for administrative penalties.
Administrative penalties for violating the provisions of Item 8.
If no measures are taken to eliminate the hidden dangers of construction safety accidents, administrative sanctions shall be imposed on the construction unit in accordance with Article 71 of the Construction Law, and administrative measures shall be imposed on the project manager in accordance with Article 58 or 66 of the Regulations on Construction Project Safety in Production Management. X. Administrative Penalties for Violating the Tenth Provision
Failure to report production safety accidents in accordance with regulations shall impose administrative penalties on the project manager in accordance with Article 58 or 66 of the “Regulations on the Management of Work Safety in Construction Engineering”.
Annex 2
Regulations on the management of scores of quality and safety violations of construction project managers
I. The construction project manager (hereinafter referred to as the project manager) quality and safety violations and scoring cycle is 12 months, with a perfect score of 12 points. Calculated from the date when the construction project under the responsibility of the project manager obtains the Construction Engineering Construction Permit.
2. According to the type and severity of the project manager's quality and safety violations and violations, the score of one score is divided into 12 points, 6 points, 3 points, and 1 point.
3. If the project manager has any of the following behaviors, he will score 12 points at a time:
(1) Acting as project manager beyond the scope of practice or failing to obtain a certificate of safety in production assessment;
(2) Those who still serve as project managers after the expiry of their professional qualification certificate or safety production assessment certificate;
(3) Quality and safety accidents caused by failure to perform the duties of production safety management or the implementation of laws and regulations, and mandatory standards for engineering construction;
(4) Misreporting or concealing quality and safety accidents;
(5) Intentionally destroying the accident site or failing to carry out emergency rescue after a quality safety accident.
4. If the project manager has any of the following behaviors, he will score 6 points at a time:
(1) Acting as project manager on two or more engineering projects at the same time in violation of regulations;
(2) Failure to organize construction in accordance with engineering design drawings and construction technical standards;
(3) failing to organize the preparation, demonstration and implementation of special construction plans for some sub-projects with greater risks;
(4) Failure to organize witness sampling of test blocks, test pieces and related materials related to structural safety according to regulations;
(5) The samples submitted for inspection are fraudulent;
(6) Tampering with or falsifying the test report;
(7) Expressing or suggesting that the testing institution issues a false test report;
(8) Failure to participate in the acceptance of the branch project, or the acceptance of the unit project and the completion of the project;
(9) signing false documents;
(10) Those who are more dangerous for some subprojects are not on duty at the site during the construction period;
(11) Failure to organize acceptance before use of lifting appliances, formwork supports, etc .;
(12) using hoisting machinery with ineffective safety protection devices;
(13) Use of processes, equipment and materials that endanger construction quality and safety that have been eliminated or banned by the state;
(14) Failure to organize and implement the requirements for rectification of hidden dangers of quality and safety proposed by the competent department of housing urban and rural construction and relevant units of engineering construction.
5. If the project manager has one of the following behaviors, he will score 3 points at a time:
(1) The project manager agreed in the contract has not performed his post;
(2) Failure to organize inspection of building materials, structural parts, equipment, ready-mixed concrete, etc. entering the site according to regulations;
(3) Failure to organize the inspection and acceptance of concealed projects in accordance with regulations;
(4) Misappropriating safety production costs;
(5) The on-site operators have not been equipped with safety protective equipment to work on the job;
(6) Failure to organize hidden inspections of quality and safety hazards, or inadequate investigation and management of hidden hazards;
(7) Special operations personnel are employed without a license;
(8) Operators who have not been employed for quality and safety education.
6. If the project manager has any of the following behaviors, he will score 1 point at a time:
(1) Failure to allocate full-time quality and safety management personnel as required;
(2) Failure to implement the quality and safety responsibility system;
(3) Failure to implement the enterprise quality and safety management rules and regulations and operating procedures;
(4) Failure to organize the construction organization design or formulate quality and safety technical measures in accordance with regulations;
(5) Failure to organize the implementation of quality and safety technologies;
(6) Failure to sign the acceptance document or hidden danger rectification report or to be signed by others on the behalf.
7. The competent department of housing, urban and rural construction in the place where the project is located finds that the project manager has violations of quality and safety laws and regulations during the inspection, he shall be ordered to make corrections and score points in accordance with these regulations; during one inspection, the project manager is found to have two or more quality and safety violations. Violations shall be scored separately and the points shall be accumulated.
8. If the project manager accumulates more than 6 points in a scoring cycle, the department in charge of housing and urban-rural construction of the project location shall implement key supervision over the engineering projects in its charge and increase the frequency of spot checks for law enforcement.
IX. If the project manager accumulates 12 points in a scoring cycle, the housing and urban-rural construction authority shall order the project manager to stop practicing for 1 year according to law; if the circumstances are serious, the practicing qualification certificate shall be revoked and registration shall not be made within 5 years; causing significant quality In the event of a security accident, registration will not be granted for life. During the period when the project manager ceases to practice, the project manager shall receive quality and safety education and training organized by the competent department of housing and urban-rural construction, and the construction unit to which the project manager belongs shall replace the qualified project manager in accordance with the prescribed procedures.
10. The administrative departments of housing, urban and rural construction of the people's governments of provinces, autonomous regions and municipalities directly under the Central Government may, in accordance with these Measures, formulate implementation rules in combination with the actual conditions in their respective regions.
