Some Regulations on Regulating the Position of Project Managers and Project Directors in Henan Province (Trial)
Article 1 In order to further implement the quality and safety responsibilities of construction project managers and project directors, standardize the registration behavior of registered builders as project managers and registered supervision engineers as project directors, and avoid the occurrence of project managers and project directors exceeding the specified number of positions and winning bids without authorization Replacement of project managers, project directors, bidding and non-compliance, and other breaches of trust, in accordance with relevant laws, regulations, rules, and regulatory documents, combined with the province's actual conditions, formulate these regulations.
Article 2 These regulations are applicable to the construction units and supervision units responsible for the construction, decoration and fitting of various types of housing construction, municipal infrastructure projects and their ancillary facilities, and supporting lines, pipelines, and equipment installation projects in the administrative region of our province. Article 3 The provincial housing and urban-rural construction authority established the province's "Project Manager and Project Director Under Construction Project Information Query Subsystem" in the "Construction Market Supervision Information System of Henan Province" to select construction, supervision units, project managers, and projects for construction units. Directors and public inquiries provide information work platforms.
Article 4 The competent department of housing urban and rural construction of the people's government at or above the county level shall adopt the "Project Manager and Project Director Information Query Subsystem for Projects Under Construction", and shall be responsible for the construction and supervision of construction projects within the administrative area when the bid is filed or approved for direct contract And project manager, project director under construction project information entry, record the number of positions of the project manager and project director; if the number of positions reaches the prescribed limit, their qualifications for bidding or contracting shall be suspended in accordance with the law, the number of positions reduced below the prescribed limit (Excluding this number), it shall immediately lift its restrictions on suspension of bids or qualifications for undertaking projects.
"Henan Provincial Construction Market Supervision Information System" establishes a linkage mechanism between the enterprise database, the employee database, and the project database to share information on the number of project managers or project directors in construction.
Article 5 The construction unit shall not appoint the same registered builder as the project manager of two or more construction projects (that is, the person in charge of the construction project, the same below).
A construction project that is subcontracted or constructed in stages for the same engineering project and undertaken by the same site and the same construction unit may be considered as one engineering project, but shall not exceed the scale of the registered construction engineer's practice.
Article 6 The working hours of a project manager are calculated according to the following rules:
(1) For the bidding project, the starting time shall be the date on which the bookmark of the bid notification is issued;
(2) For direct outsourcing projects, the starting time shall be the date of approval of the direct outsourcing application;
(3) Projects contracted by construction units and their project managers in other provinces or systems shall also be counted as the number of project manager positions.
Article 7 If one of the following situations occurs in a construction project, it will no longer be counted as the number of positions of the project manager:
(1) The project has been completed and passed the acceptance check;
(2) All the projects within the scope of the project contract have been completed, the construction unit has issued a completion report, and the supervision unit has issued a quality evaluation report. The non-construction unit has temporarily failed to complete the completion and acceptance formalities. Another post
(3) For reasons other than the construction unit, if the bid (direct contract issuance) notification is filed (approved) for more than 120 days without construction, the construction unit agrees in writing to the project manager to hold another post;
(4) If the construction project is suspended for 120 days due to non-construction reasons and construction is still not possible, the construction and supervision unit has agreed in writing to the project manager to hold another post.
For the above reasons, if the project manager of the construction unit needs to take another post, he shall bring the relevant certification materials to the place where the project is awarded (direct contracting) for the record (approval) registration department to inform the record. Article 8 The supervision unit shall appoint a registered supervision engineer as the chief engineer of a construction project supervision contract. When it is necessary to act as the chief engineer of a number of construction engineering supervision contracts at the same time, it shall be agreed in writing by the construction unit, and shall not exceed 3 items, and shall not exceed the scope of the engineering supervision business of the corresponding professional engineering category construction project of the enterprise.
A construction project that is contracted or constructed in stages by the same engineering project and that is contracted by the same site and the same supervision unit can be regarded as one engineering project.
Article 9 The term of office of the project director is calculated according to the following rules:
(1) For the bidding project, the starting time shall be the date on which the bookmark of the bid notification is issued;
(2) For direct contracting projects, the starting time shall be the date of approval of the direct contracting notice;
(3) Projects contracted by the supervision unit and its project director in other provinces or systems shall also be included in the number of project directors.
Article 10 If one of the following situations occurs in a construction project, it will no longer be counted as the number of project directors:
(1) The project has been completed and passed the acceptance check;
(2) All the projects within the scope of the project contract have been completed, and the non-supervision unit has temporarily failed to complete the completion and acceptance formalities, and the construction unit has agreed in writing to the project director to hold another post;
(3) For reasons other than the supervision unit, if the notice of winning the bid (direct contracting) has been filed (approved) for more than 120 days and no supervision has been carried out on the site, or the project has been suspended for 120 days, the construction unit has agreed in writing to the project director to hold another post of;
For the above reasons, if the project director of the supervision unit needs to hold another post, he shall bring relevant certification materials to the place where the project is awarded (direct contracting) for the record (approval) registration department to inform the record. The registration and registration department shall immediately pass the "Project Manager and Project Director's Project Information Inquiry Subsystem under Construction" to immediately lift its restrictions on the suspension of bids or qualifications for undertaking projects.
Article 11 After the construction and supervision contract is signed, the project manager and project director identified in the contract shall fully perform the obligations stipulated in the contract, and the project manager and project director shall not change it without authorization.
If the project manager and the project director really need to change, they must strictly follow the “Registration Measures for Registered Architects' Practice (Trial)” and other regulations to go to the project location where the project was awarded (direct contracting) for the record (approval) registration department to go through the relevant change notification filing procedures. After the change, the project manager and project director must not be lower than the original project leader qualification level and be professionally consistent. Those who do not meet the conditions for change shall not go through the change formalities.
Article 12 Under any of the following circumstances, the construction unit, construction unit and supervision unit may apply for change of the project manager and project director:
(1) Those who fail to work in the project management , fail to perform their job duties seriously, and the construction unit requests replacement;
(2) Those who leave the company or continue to sign labor contracts after the expiry of the labor contract;
(3) Those who cannot adhere to the management of the construction site due to illness or other physical reasons, or who have been abroad or studied for a long time (3 months or more), are unable to perform their duties due to job changes, resignations, reaching the retirement age, etc .;
(4) Being ordered to stop practicing or suspend the qualifications of the project manager and project director due to violation of laws or regulations or major quality and safety accidents, and to cancel the qualification certificates of the construction engineer and supervision engineer;
(5) Being detained or sentenced for suspected crime or crime;
(6) Other irresistible reasons.
Article 13 To apply for the change of project manager and project director, the following materials shall be issued:
(1) The construction unit or supervision unit downloads and fills in the "Project Manager (Project Director) Change Record Form" from the "Project Manager and Project Director Under Construction Project Information Query Subsystem", and uploads the record form and related attachments;
(2) If the replacement belongs to a situation in which the project management is not available, the duties of the post have not been seriously performed, and the construction unit requires a replacement, the change documents issued by the construction unit and the supervision unit shall be provided when filing.
(3) In case of change of position, resignation or resignation from the original working enterprise, the record of job change, resignation approval document or resignation issued by the original enterprise shall be provided for the record;
(4) For replacements that are unable to adhere to the management of the construction site due to physical reasons such as illness, the record of the disease diagnosis issued by the medical institution at or above the county level and signed by the attending physician and the specific length of hospitalization and recuperation shall be provided;
(5) If the replacement belongs to a long-term study abroad or study situation, proof of going abroad and study should be provided when filing;
(6) For the replacement of situations that have been ordered to stop practicing illegally, detained or sentenced for suspected crime or crime, or other irresistible reasons, relevant certification documents shall be provided when filing;
(7) Life quality responsibility commitment and legal representative authorization letter signed by the new project manager and project director.
Article 14 If the project manager or project director changes due to the reasons in Article 13, he shall go to the registration site of the bid (direct contract) for the record (approval) registration department to complete the notification and record formalities within 5 working days.
Article 15 For those who meet the conditions for change, the staff of the registration department (the direct contract out) for the record (approval) of the project site logs on to the "Project Manager and Project Director Under Construction Project Information Inquiry Subsystem" to handle related changes and print "Project Manager (Project Director) Change Record Form "in triplicate, construction (supervision), construction unit, and filing department each hold a record for inspection, and the change unit will submit a copy of the changed project manager (project director) record form to the quality And safety supervision departments.
The time limit for processing the change is 1 working day; in special circumstances, it can be extended for 1 working day. If the conditions for change are not met, the staff shall inform the change unit of the existing problems at one time.
Where the competent department of housing and urban-rural construction at or above the county level records changes in the project manager or project director in accordance with regulations, the record of the original project manager or project director's appointment in the project shall be maintained until the project is completed for acceptance. The performance of the project is recorded in the credit file of the changed project manager or project director, and the performance of the original project manager or project director is cancelled.
Article 16 If the construction or supervision unit changes the project manager or project director without authorization or does not notify the record after the change, the project manager and project director who won the contract (contracting) do not perform their job duties at the construction site. Construction and supervision units will deduct points; if the inspection fails to reach the post for three times or fails to perform the duties of the post, a rectification notice will be issued and the correction will be issued. Article 17 The competent department of housing urban and rural construction of the people's government at or above the county level shall establish a reporting account to illegally change the project manager, project director, or winning (contracting) project manager and project director of the construction or supervision unit. Clues for violations shall be registered and accepted, and after investigation, investigations shall be conducted in accordance with the provisions of Article 16, and the results of investigations shall be notified to the informant.
Article 18 The information about the positions of project managers and project directors under construction in the Henan Construction Market Supervision Information System is subject to the information of the Project Manager and Project Director Under Construction Project Information Inquiry Subsystem; project managers outside the system, The position information of the project director's construction project is subject to the actual verification information.
Article 19 The interpretation of these regulations shall be made by the Provincial Department of Housing, Urban and Rural Construction, and shall be implemented as of May 1, 2015.
